1. Introduction

Welcome to Not.tf ("Not.tf", "Not Too Far", "we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of our mobile app building platform, including our website, applications, and services (collectively, the "Service").

By accessing or using our Service in any way, you unconditionally agree to be legally bound by these Terms. If you disagree with any part of these Terms, you must immediately cease all use of the Service and may not access it under any circumstances.

Your continued use of the Service constitutes acceptance of any modifications to these Terms, which we may change at any time without prior notice.

2. Account Registration and Security

To use certain features of our Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept sole and complete responsibility for all activities that occur under your account, regardless of whether such activities were authorized by you
• Notify us immediately of any unauthorized use of your account

You acknowledge that Not.tf bears no responsibility for any losses, damages, or liabilities arising from unauthorized access to your account, whether due to your negligence or otherwise.

3. Use of Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates applicable laws or regulations
• Impersonate or attempt to impersonate Not.tf, a Not.tf employee, another user, or any other person or entity
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
• Use any robot, spider, or other automatic device to access the Service for any purpose
• Introduce any viruses, trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful
• Attempt to gain unauthorized access to any portion of the Service or any other systems or networks

4. AI-Generated Content

Our Service uses artificial intelligence to generate mobile app code and designs. You expressly acknowledge and agree that:

• AI-generated content may contain errors, bugs, security vulnerabilities, or other defects
• You bear sole and exclusive responsibility for reviewing, testing, and validating all generated code before any use
• Not.tf makes no representations or warranties regarding the accuracy, reliability, completeness, or fitness of any AI-generated content
• Not.tf is not responsible for any damages, losses, or liabilities arising from your use of AI-generated content
• You assume all risks associated with using AI-generated code in production environments
• You retain ownership of projects created using our Service, but grant Not.tf a perpetual, irrevocable, worldwide license to use, modify, and incorporate any data, prompts, or content you provide to improve our services
• Generated code is provided "AS IS" without warranties of any kind, express or implied

5. Credits and Subscriptions

Our Service operates on a credit-based system with various subscription tiers:

• Credits are consumed when generating or modifying app content with AI
• Credits reset monthly based on your subscription tier
• Unused credits do not roll over to the next billing period
• Subscription fees are billed in advance on a monthly or annual basis
• You may cancel your subscription at any time, effective at the end of your current billing period

6. Payment Processing

All payments are processed by Lemon Squeezy (a Stripe company), our authorized merchant of record. By making a purchase, you also agree to Lemon Squeezy's terms of service and privacy policy. Not.tf does not store your full payment card details.

7. No-Refund Policy

ALL PURCHASES ARE FINAL AND NON-REFUNDABLE. By completing a purchase, you expressly acknowledge and agree that:

• Access to our Service is granted immediately upon payment, constituting full delivery of the digital service
• No refunds will be issued for subscription fees, credit purchases, or any other charges, including for partial billing periods or unused credits
• Cancellation of a subscription stops future billing but does not entitle you to a refund of any amounts already charged
• You waive any statutory cooling-off or withdrawal right to the extent permitted by applicable law, given that the digital service has been fully delivered immediately upon purchase
• Exceptions may be granted solely at Not.tf's discretion in cases of verified technical failure directly caused by Not.tf

If you believe you have been charged in error, you must contact us at legal@not.tf before initiating any payment dispute with your bank or payment provider.

8. Chargebacks and Payment Disputes

Filing a chargeback or payment dispute without first contacting us constitutes a material breach of these Terms. You acknowledge and agree that:

• Upon initiation of a chargeback or payment dispute, your account will be immediately suspended pending investigation
• If a chargeback is confirmed, your account will be permanently terminated and you will be banned from creating future accounts
• All projects, data, and content associated with your account may be deleted following a confirmed fraudulent chargeback
• We reserve the right to dispute any chargeback we believe to be fraudulent and to submit evidence of service delivery to the relevant payment processor
• You may be held liable for chargeback fees, costs of investigation, and any other costs incurred as a result of a fraudulent dispute
• Financial records related to the transaction will be retained as required by applicable law regardless of account status

9. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of Not.tf and its licensors. You retain ownership of the projects and apps you create using our Service.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOT.TF, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or business opportunities
• Loss of use, goodwill, or other intangible losses
• Cost of procurement of substitute goods or services
• Damages resulting from your access to, use of, or inability to access or use the Service
• Damages resulting from any conduct or content of any third party on the Service
• Damages resulting from any content obtained from the Service, including AI-generated code
• Damages resulting from unauthorized access, use, or alteration of your transmissions or content
• Damages resulting from bugs, viruses, or other harmful components in generated code
• Damages resulting from errors, mistakes, or inaccuracies in any content or code
• Personal injury, property damage, or any other damages whatsoever

IN NO EVENT SHALL NOT.TF'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID NOT.TF IN THE LAST SIX (6) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Disclaimer of Warranties

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND.

NOT.TF EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Warranties of fitness for a particular purpose
• Warranties of non-infringement
• Warranties of accuracy, reliability, or correctness
• Warranties that the Service will be uninterrupted, timely, secure, or error-free
• Warranties regarding the quality, accuracy, or reliability of any content, including AI-generated code
• Warranties that any defects will be corrected
• Warranties regarding results obtained from using the Service

NOT.TF MAKES NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS. YOU ACKNOWLEDGE THAT ANY RELIANCE ON THE SERVICE OR GENERATED CONTENT IS AT YOUR OWN RISK.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM NOT.TF OR THROUGH THE SERVICE WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

13. Changes to Terms

We reserve the right to modify, amend, or replace these Terms at any time, in our sole discretion, without prior notice. We may or may not notify you of changes, and notification is not required.

It is your responsibility to check these Terms periodically for changes. Your continued use of the Service following any changes constitutes acceptance of those changes, whether or not you have reviewed them.

If you do not agree to any modification of these Terms, you must immediately cease using the Service.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Not.tf is registered, without regard to its conflict of law provisions.

15. Indemnification

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, you agree to indemnify, defend, and hold harmless Not.tf ("Not Too Far") and each of its past, present, and future affiliates, subsidiaries, parent companies, officers, directors, shareholders, members, managers, employees, agents, contractors, subcontractors, licensors, service providers, successors, and assigns (collectively, the "Not.tf Parties") from and against any and all claims, demands, actions, proceedings, investigations, liabilities, losses, damages (direct, indirect, incidental, special, consequential, punitive, or exemplary), judgments, settlements, fines, penalties, interest, costs, and expenses of any kind (including reasonable attorneys' fees, court costs, expert witness fees, and litigation expenses) arising out of or in any way related to:

• Your access to or use of the Service, or your inability to access or use the Service
• Your violation or alleged violation of any provision of these Terms or any other agreement with Not.tf
• Your violation or alleged violation of any applicable law, regulation, rule, order, or governmental requirement
• Your violation or alleged violation of any third-party right, including any intellectual property right, privacy right, publicity right, or proprietary right
• Any content, data, prompts, or materials you submit, upload, transmit, or make available through the Service
• Your use, deployment, distribution, or commercialization of any AI-generated code, designs, or content produced by the Service, in any application, product, or service
• Any claim that your use of the Service or any AI-generated output caused harm to a third party, including product liability claims, personal injury, property damage, or financial loss
• Your misrepresentation of any information provided to Not.tf or in connection with the Service
• Any dispute between you and another user, customer, client, employer, or third party arising from your use of the Service or AI-generated content
• Any tax liability, regulatory fine, or government-imposed penalty arising from your use of the Service or outputs thereof
• Your fraud, gross negligence, or willful misconduct
• Your breach of any representation or warranty made under these Terms
• Any claim arising from products, services, or applications you build using the Service or AI-generated outputs
• Your failure to obtain any necessary consents, licenses, or permissions required to submit content to, or use outputs from, the Service

Not.tf reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with Not.tf in asserting any available defenses and to not settle any such matter without Not.tf's prior written consent. You agree not to settle any claim without Not.tf's prior written consent.

Your indemnification obligations will survive the termination or expiration of these Terms and your use of the Service.
